BUCKSAA TERMS & CONDITIONS

1. BINDING CONTRACT

Please read these Terms of Service (“Terms”) and our Privacy Policy carefully before using our website (“Website”). By accessing or using the Website or purchasing any products displayed on it, you acknowledge that you have read, understood, and agreed to be legally bound by these Terms and the Privacy Policy, including all rules, policies, and procedures of SMART SPEND SOLUTIONS (“SSS”), operating as Bucksaa.

These Terms form a legally binding contract between you and SSS. If you do not agree with these Terms, you should discontinue the use of the Website immediately.

2. ELIGIBILITY TO USE

“You” refers to an individual user or, where applicable, the company/legal entity that you represent.

To use the Website:

  • You must be 18 years or older, or

  • If acting on behalf of a company or legal entity, you must be duly authorized to do so.

SSS reserves the right to suspend or terminate access if it is determined that the user is under 18 or otherwise violates these Terms.

3. ACCOUNT & REGISTRATION OBLIGATIONS

By creating an account, you represent that:

  • You are legally competent to enter a binding contract.

  • All information submitted during registration is true, accurate, current, and complete.

  • You will promptly update any changes to your information.

If inaccurate or incomplete information is provided, SSS may suspend or terminate your account.

You are responsible for maintaining the confidentiality of your login ID and password and for all activities under your account. SSS will not be liable for losses caused by your failure to protect account credentials.

4. CONTENT, COPYRIGHT & INTELLECTUAL PROPERTY

All material displayed on the Website—including designs, graphics, images, text, and content (“Content”)—is protected under copyright and intellectual property laws.

Important points:

  • SSS does not prescreen designer content uploaded to the platform.

  • Designers retain all intellectual property rights for their artwork and products.

  • SSS acts solely as an intermediary platform and does not own or control design rights.

  • Any claims regarding infringement must be directed to the respective designer/artist.

If you believe any content infringes your rights, you may submit a written notice to our designated Intellectual Property Rights Agent.

5. GRANT OF RIGHTS & USER CONDUCT

SSS grants you a limited, non-transferable, revocable license to use Website services in accordance with these Terms.

You agree to:

  1. Maintain accurate account details.

  2. Ensure your access to the Website is lawful.

  3. Use proper security measures to protect your device and systems.

SSS is not responsible for disputes between users and designers. Payments for designer-uploaded products are made directly to the designer; SSS only facilitates the transaction.

6. CREDIT CARD DETAILS

You agree that:

  • You will use only cards legally owned by you.

  • All payment information provided is accurate.

  • SSS does not store credit/debit card or banking details.

If payment authorization fails, the transaction is treated as failed. Any deducted amount (if any) will be refunded by the bank/payment gateway.

7. FRAUDULENT OR DECLINED TRANSACTIONS

Any fraudulent activity—such as misuse of vouchers or unauthorized payments—may result in:

  • Cancellation of orders

  • Account deletion

  • Legal action

  • Recovery of losses, legal fees, and collection charges

SSS retains the right to refuse service in such cases.

8. ELECTRONIC COMMUNICATIONS

By using the Website, you consent to receive communications from Bucksaa electronically, including:

  • Emails

  • Notices

  • Promotional updates

Electronic communication satisfies all legal requirements for written communication.

9. SMS COMMUNICATION

By registering, you agree that Bucksaa may send:

  • Promotional messages

This applies even if your number is registered under DND (Do Not Disturb).

10. USER RESPONSIBILITIES

13. GOVERNING LAW & JURISDICTION

These Terms shall be governed by Indian law.

  • Legal jurisdiction: New Delhi, India

  • Arbitration venue: Mumbai, India

  • Arbitration governed by the Arbitration and Conciliation Act, 1996 (as amended)

  • Proceedings will be in English

14. REVIEWS, FEEDBACK & SUBMISSIONS

Any content submitted to Bucksaa—feedback, reviews, comments—becomes the property of SSS.

SSS may:

  • Publish

  • Modify

  • Distribute

  • Use commercially

…without any compensation to you.

You warrant that your submissions:

  • Do not infringe any third-party rights

  • Are not illegal, defamatory, obscene, or harmful

  • Do not contain viruses or spam

SSS is not responsible for comments posted by users or third parties.

15. INDEMNITY

You agree to indemnify and hold SSS, its employees, directors, and agents harmless from all claims, damages, losses, or expenses arising out of:

  • Your actions

  • Violation of these Terms

  • Infringement of third-party rights

  • Misuse of the Website

This indemnity obligation survives termination of these Terms.

16. TERMINATION

SSS may:

  • Terminate your account

  • Block your IP

  • Suspend access

You may terminate your account anytime by discontinuing use of the Website.

17. LIMITATION OF LIABILITY

The Website is provided on an “as is” basis.

SSS is not liable for:

SSS’s total liability, if any, is limited to the value of the product purchased.

Violations may result in legal action.

19. ENTIRE AGREEMENT

These Terms constitute the complete agreement between you and Bucksaa regarding Website usage.

If any provision is found unenforceable, it will be replaced with a valid provision without affecting the remaining Terms.

OFFERS & PROMOTIONS

Bucksaa may run promotional offers, discounts, bundle schemes, or limited-period deals on selected products. All promotions are governed by the terms listed below and may be modified, paused, or withdrawn at the sole discretion of Bucksaa without prior notice.

1. General Conditions

  • All offers are applicable only on purchases made through the official Bucksaa website.

  • Offers cannot be combined with any other scheme unless explicitly stated.

  • Discounts apply only when all eligibility conditions are met.

  • In the event of order cancellation or return, refunds will be adjusted after deducting the benefit availed under any offer, including the value of free products or complimentary gifts.

  • Offers have no cash value and cannot be redeemed or exchanged for cash.

2. Coupon Code Requirements

3.4 Bags Category Offers

4. Modification & Discontinuation

Bucksaa reserves the right to modify offer terms, eligibility criteria, discount values, or discontinue any promotion at its discretion without prior notice.

5. Misuse of Offers

Bucksaa reserves the right to cancel orders, revoke discounts, or suspend accounts in cases of:

  • Misuse of coupon codes

  • Bulk purchase attempts for resale

  • Fraudulent activity or violation of Terms & Conditions
